You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. You may not copy, display, distribute, transfer, link to, reproduce, license, frame, alter, create derivative works of or republish all or any portion of the Site or any of the LanguageLine IP for any commercial or public purpose without Language Line’s prior written consent.
LANGUAGE LINE SERVICES®, LanguageLine Solutions®, LanguageLine®, MyLanguageLine.com, the LanguageLine Solutions Logo, InSight® and Language Line Academy® are all federally protected trademarks owned by LanguageLine (the "Trademarks").
You may not use, copy, display, distribute, modify or reproduce any of the LanguageLine IP found on the Site except as authorized in this paragraph. You may not use any of the Trademarks or any URL or domain name containing any of the Trademarks except pursuant to a written trademark license agreement from LanguageLine.
You will be invited to register at the Site to gain access to certain reports, invoices and customer specific information. In registering for the Services, you agree to provide accurate, true, current, and complete information about you and/or your business as requested by the registration screens. As a convenience to you, a profile for you and/or your business may be created based on the registration information that you provide. You are cautioned not to disclose your user specific login information including User IDs and passwords with anyone other than those individuals in your organization who you designate as having authority to access your specific information and agree that LanguageLine is not and cannot be held responsible for unauthorized access to this information. You specifically agree that you will not share any registration information, the Site or any screen shots or copies of pages on the Site with anyone outside of your organization. LanguageLine reserves all of its rights to enforce against any violation of this Agreement.
THE SERVICES ARE OFFERED ON AN "AS IS," "WHERE IS" AND "WHERE AVAILABLE" BASIS, WITH NO WARRANTY OF ANY KIND-WHETHER EXPRESS, IMPLIED OR STATUTORY-INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DOES NOT AFFECT THOSE WARRANTIES WHICH INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.
YOU ACKNOWLEDGE THAT NEITHER LANGUAGELINE, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT THE SERVICES OFFERED OR THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES OR THE SITE, OR AS TO THE TIMELINESS, SEQUENCE, ACCURACY, RELIABILITY, COMPLETENESS OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SERVICES AND THE SITE.
EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT OR WHERE THE LAW REQUIRES A DIFFERENT STANDARD, YOU AGREE THAT LANGUAGELINE IS NOT RESPONSIBLE FOR ANY LOSS, PROPERTY DAMAGE OR BODILY INJURY, WHETHER CAUSED BY ACCESS TO OR USE OF THE SERVICES OR THE SITE. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW, LANGUAGELINE WILL NOT BE RESPONSIBLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL, ECONOMIC OR OTHER DAMAGES ARISING IN ANY WAY OUT OF THE INSTALLATION OR USE OF THE SERVICES, THE SITE, ANY ON-LINE SERVICES OR INTERNET BROWSER SOFTWARE, INCLUDING LIABILITY ASSOCIATED WITH ANY COMPUTER VIRUSES WHICH MAY INFECT YOUR COMPUTER SYSTEM.
LanguageLine reserves the right to modify these Terms of Use at any time without notice. If you find the Terms of Use unacceptable at any time, you may discontinue your use of the Services and the Site. By continuing to use the Services and the Site after the date of any change to these Terms of Use, including accessing the Site, you agree to be bound by the rules contained in the most recent version of this Agreement.
LanguageLine reserves the right to modify or terminate the Services and the Site or to terminate your access to the Services and Site, in whole or in part, at any time. These Terms of Use constitute a contract between you and LanguageLine governed by the laws of the State of California, with the exception of its conflicts of laws provisions.
You agree to defend, indemnify and hold harmless LanguageLine, its affiliates and their respective directors, officers, employees and agents from and against all claims, monetary damages and expenses, including attorneys' fees, arising out of your violation of these Terms of Use or misuse of the Service or this Site, including such violation or misuses conducted by your employees or agents, if applicable.
The LanguageLine Customer Reporting Tools that may be offered as part of the Services are designed to assist Customers with an overview of the use of LanguageLine products and services. These tools are predicated on the understanding that the information displayed is based on data collected through direct machine interfaces and has not undergone any level of audit, review or validation. As such, the data should ONLY be used as a basis for review and NOT as a valid source of billing, costs, or any other critical financial need. As an example; review of call data in this system mid-month will not be an accurate representation of the information contained on your actual monthly invoice.
You are advised the information presented IS NOT your actual periodic invoice and should not be used to pay, audit or dispute the actual invoice(s) received from LanguageLine.
All of the information presented on this Site is considered Confidential and Proprietary and must not be disclosed to anyone outside your organization. Questions regarding the information found in any report generated by this Site should be directed to your LanguageLine Account Representative.
You are solely responsible for the security of your User Name and passwords and for the Customer Identification Number You have been assigned by LanguageLine for using the Services. You are solely responsible and liable for any activity that occurs under your account, including by anyone who uses your account. If there is any unauthorized use or access to your account, you must let us know immediately. LanguageLine is not responsible for any loss caused by unauthorized use of or access to your account; however, You may be liable for any losses LanguageLine or others suffer because of the unauthorized use.
The laws of the State of California, excluding its conflicts of law rules, govern this license and Your use of the Software. Your use of the Software may also be subject to other local, state, federal, or international laws.
